ESTATE PLAN

Individual Estate Plan (1 Person) – $500

Couple’s Estate Plan (2 Persons) – $750

Includes the following Items:

    • Last Will and Testament – establishes individuals or entities to manage and control the estate and designates the beneficiaries entitled to the assets. 
    • Memorandum of Belongings – this document is normally completed after the Last Will and Testament and designates personal property items the client wants distributed to specific individuals (excluding cash). This document may be changed over time without having to change the Last Will and Testament.
    • Statutory Durable Power of Attorney – establishes individuals authorized to conduct specific business and financial matters on behalf of the client. While most powers of attorney become void automatically when the client becomes incapacitated, this document is Durable and survives a period of incapacity. 
    • Medical Power of Attorney – establishes individuals authorized to make medical decisions on behalf of the client during the client’s periods of incapacity. 
    • HIPAA Release – authorizes release of the client’s medical history to others. 
    • Declaration of Guardian – establishes specific individuals that may serve as either Guardian of the client’s estate (business and financial) or Guardian of the client’s person (medical matters). 
    • Declaration of Guardian for Minor Children – designates individuals the client wishes to care for minor children in the event the client becomes incapacitated or dies. 

TRUST

Trust with a Single Real Estate Transfer or Insurance Policy – $750 plus filing fees

Each Additional Real Estate Transfer – $100 plus filing fees.

Includes the following Items:

    • Trust Agreement – This is a confidential document and is not filed for record anywhere. This document sets up the terms of the trust and names the Beneficiaries of the trust, the person overseeing the trust assets called the Trustee and the person establishing the trust called the Settlor. 
    • Certificate of Trust – This is usually a one-to-two-page document that summarizes the trust agreement. This document is filed in the property records of the county the trust assets are located and where the Trustee resides. 
    • Warranty Deed – This document transfers real property into the trust, normally the person’s homestead but any real property may be transferred as well. When completed, this document is filed in the county where the real property is located. 
    • EIN – Federal Employer Identification Number for reporting to the IRS.
    • Application for Homestead/Senior Exemption – When a residence is placed into a trust, a new application for homestead and/or senior tax exemption must be resubmitted.
