Hi, I’m Mike Gonzalez. I’m a Texas Attorney and I’ve been practicing law for nearly 20 years. The first three years of my career were spent working for a Firm practicing family law, which caused me to begin questioning my career choice. But then I discovered that Probate, Trusts, and Estate Planning was my real passion and it’s formed the basis of my practice at the Law Offices of Michael W. Gonzalez, PLLC for the last 17 years. But in 2017, I decided to scale back my law practice. I discontinued all litigation, sold my law office, and now I only focus on the development and management of Estate Planning and Trusts. Since I no longer have an office, I’ve created, Texas Online Estate Planning. This is not a service or website where you fill in the blanks on a form template and print out your documents. This is a cost-effective professional legal service provided by a licensed attorney in the state of Texas for about half the cost you would pay at a law office. Through my online service, Texas Online Estate Planning, I’m able to pass huge savings on to you because I no longer maintain an expensive office with the ever-increasing taxes, high cost of payroll, and other outrageous expenses associated with operating a law firm.

So what is estate planning? Estate planning is the process of organizing and managing an individual’s assets and financial obligations after death or during a disability.  It can include making a will, setting up a trust, making charitable donations, establishing powers of attorney, naming an executor or guardian for children, and preparing funeral arrangements. Setting up a basic estate plan for an individual or couple usually requires the following documents: 1. The Last Will and Testament; 2. Memorandum of Belongings; 3. Durable Power of Attorney; 4. Medical Power of Attorney; 5. Physician Directive, often referred to as a living will; 6. Declaration of Guardian for yourself; 7. Declaration of Guardian for Minor Children; and 8. Agent for receipt of remains. 

In addition to an individual or couple’s basic estate plan documents, a Trust may be needed to protect an asset or avoid potential liability from the asset. Trusts are also used to prevent a beneficiary from wasting or losing an inheritance, or to receive, manage, and distribute life insurance funds with specific terms and provisions. Although a Trust can be used to avoid probate, I usually do not recommend it for that reason alone. To avoid probate, nearly all of a person’s assets must be transferred into the trust. In my experience, additional assets are usually purchased after initially creating the trust without properly placing them in the trust. As a result, probate still becomes necessary to transfer the additional assets over to the intended beneficiaries.

Then once I’ve completed your documents, I will email you a draft copy for your review, and when all revisions and modifications are completed, I will go over the documents with you to make sure you understand each one and answer any questions you may have. Then, at no additional charge, I can oversee your signing of the documents by video link or phone to ensure it is completed properly.
However, please be aware that by establishing an estate plan you will confer legal authority to others to act on your behalf. To protect the public from fraud, Texas Law requires you to sign the documents in the presence of a notary. Furthermore, two of the documents will require two witnesses in addition to the notary. Please be aware that our services do not include the cost of a notary or witnesses. If you do not have a notary that you regularly use, upon your request, we will locate a mobile notary service for you to contact and schedule for the signing of your documents. We are not associated with any notary service and will not benefit financially from their services. You will need to arrange for the two witnesses to be present. Witnesses may be neighbors, friends, co-workers, or even strangers so long as they are at least 14 years of age and not named in the documents or potentially in line to benefit from your estate. We will be available throughout the process to ensure it is completed correctly and efficiently.

Why is your pricing so much cheaper than other attorneys?

I operate out of my home and meet with clients online. I no longer have the expense of maintaining a law office, the personnel to staff the office and the extremely high expenses associated with maintaining a law firm. Therefore, I’m able to pass the savings onto  you. 

Why should I hire you?

I have 18 years experience practicing law and my primary area of practice during this time has been in Probate, Trust and Estate Planning. I’ll never say I’ve seen it all, but if you have an issue beyond my expertise and I’m not able to help you, I will certainly put you in contact with someone that can. 

Is this just another automated service with partially completed documents?

No. I prepare all of your documents myself and unless I am already on the phone or momentarily unavailable, I personally answer my own calls, texts and emails. Other than an answering service to handle my missed calls, I do not have any employees. 

How does this process work?

Call, text or email me to set up an initial 30-45 minute consultation by telephone or zoom video conference.  During the conference I will go over the process of transferring assets to beneficiaries when a person dies, called Probate. I will describe the difference between Probate Assets and Non-Probate Assets. Finally, I will explain methods of keeping your estate out of the Probate Court. If you decide to hire me at that point, I will then collect your payment and information needed to develop your estate documents, which usually takes just a few days to complete. When finished, I can send  you the documents and signing instructions+ via email or US Postal Service. You will need to locate and hire a notary public, but I will make myself available via zoom or telephone during your signing to insure the documents are executed properly.
